fundraiser back in may. >> the president starts off with 48%, 49%, he starts off with a huge number, these are people who pay no income tax. 47% of americans pay no income tax. so our message of low taxes doesn't connect. he will be out there talking about tax cuts for the rich. that's what they sell every four years. and so my job is not to worry about those people. i will never convince them to take personal responsibility and care for their lives. what i have to convince the ones that are independent. >> that video sin complete it reportedly does not include one or two minutes of that fundraiser. so far no definitive word on why. meanwhile team romney is taking aim at this coming comment from president obama when he was in illinois state senator back in 1998. >> i think the trick is figuring out how do we structure government systems that pool resources and, hence, facilitate some redistribution because i actually believe in

redistribution, at least at a certain level to make sure that everybody has got a shot. >> shepard: two sides, two fights. we have team fox coverage of the attacks and counter attacks from both sides. ed henry is live at the white house tonight. first, let's get to carl cammeron he is live in miami. it sounds like governor romney went on the offensive today. >> well, dueling sound bites and campaigns. romney took the opportunity to counter offensive really going after president obama for his assertion that a government system needs to be designed that could pool resources to better affect the redistribution. romney went at him hard today, as did all republicans with ads and videos and direct mail and radio and tv commercials. watch. >> this idea of redistribution follows from the idea that if you have a business you didn't build it someone else did that the president saying yes he believes in redistribution. i don't. i believe the way to lift people and to help people have higher incomes is not to take

from some and give to others. but to create wealth for all of us. well, the romney campaign plans to release ads, videos as i said and around the country trying to add it in congressional and senate races thinking it could be a unifying battle cry for the final six weeks. >> that said some conservatives are is still slamming the governor on his comments about the 47%. >> nevada senator dean heller tried to distance himself from mr. romney's comments. scott brown the senator from massachusetts, mitt romney's -- where he lives now, also doing the same. and in the case of mr. romney, he isn't backing away from the assertion that there is too much of a dependency state. though he has backed away from the idea that 47% of the folks who don't pay income taxes consider themselves victims and who are owed sort of government entitlement. none the less, mr. romney very aggressively going after mr. obama for the dependency society, watch. >> the question of this campaign is not who cares

called mitt romney's campaign desperate. take a listen. >> ed, i would say that all of us who follow politics and policy, whether we're on this side or your side of the podium have seen circumstances like this where a campaign is having a very bad day or very bad week. and in circumstances like that, there are efforts made sometimes desperate efforts made to change the subject. >> carney went on to say he thinks that maybe even the romney camp has had an awful month not just a couple days or week. they obviously run the risk inside the white house of being a little bit overconfident. can i tell you they certainly feel go right now and they think mitt romney really messed up with this tape, shep. >> shepard: have they gotten into the context of what the then state senator obama said back in 1998? >> they have. jay carney insisted when i pressed him about this today look what the president was talking about then with the state senator was about local government, helping the working poor. he insists this is about

making the government more efficient, giving people opportunities, a ladder up, et cetera, the kind of things we have heard from the president on the trail. interesting that the first lady seemed to get involved as well today by hitting mitt romney. take a listen. >> as president, you trulii need a strong inner compass. a core commitment to your fellow citizens. >> core commitment to your fellow citizens. sounds like a reference to that whole 47% question you were mentioning before with carl. the bottom line is the obama camp feels like this entire debate fits into what they have been trying to do which is paint mitt romney as someone who is not standing up for the middle class. they think they have another example right here, shep. >> shepard: ed henry on the north lawn. thanks a the lo. they mentioned brand new polls. our fox news poll shows president obama is leading governor romney in three battleground states. our pollsters did the survey over the past three days. so that was before and after the release of governor romney's fundraiser video. almost completely before the release of the president's

redistribution comment. so here we go. the polls show the president leading governor romney by seven points among likely voters in both ohio and virginia. that is outside the margin of error. the president up by 5 points in florida. that is statistically a tie. the race is closer among voters who say they're extremely interested in the election. it's a statistical tie in ohio and virginia. and an actual tie in the state of florida. in all three states, likely voters say they trust the president more than they trust governor romney to improve the economy and create jobs. ohio is the only state where the president led -- or where i should say where the president's lead is outside othe margin of error. the justice department's internal watchdog releasing a highly anticipated report on the fast and furious gun sting. it criticizes more than a dozen staffers. but what about the attorney general eric holder? we'll have the details. house republicans have accused him of withholding key information. so what does the report indicate about his actions? that's coming. plus, a member of the obama administration now calling the

>> shepard: on fox tonight intelligence sources telling fox news that a former gitmo detainee with ties to al qaeda and possibly the attacks of 9/11 2001 may have led the deadly attack on the u.s. consulate in libya. this is breaking this afternoon from bret baier sources. militants stormed the con slot last week 11 years to the day of 9/11. the gunmen reportedly led a multihour assault which killed the u.s. ambassador to libya, chris stevens and three other americans. the myrtle released the deyan

dainee back in 2007. sent him to libya under the specific condition that he would stay in jail in libya. this is the only picture we have ever had of him. it's unclear to us or any of our sources how or why he got out of custody in libya. up until today, the obama administration has refused to say that the attack on libya was, indeed, terrorism. this morning that changed. in the director of national counter terrorism center matthew olson told lawmakers that it was, indeed, a terror attack. wendell goler is live at the state department with us tonight. wendell, is there new information on whether this attack was actually tied to 9/11? shep frankly it's still not clear it's hard to imagine the date was a coincidence. the attackers use a pro-tefts anti-islam film innocence of islam as a distraction. then when u.s. ambassador susan rice cast doubt on that. officials here back off and wait until the fbi completed

its investigation before, you know, saying what triggered the attack. today, as you say, the director of the national counter terrorism center in a hearing on capitol hill offered his own assessment. >> it evolved and escalated over several hours. t appears that individuals who were certainly well-armed seized on the opportunity presented as the events unfolded that evening and into the morning hours of september 12th. >> the attackers armed with rocket propelled grenades which suggest to officials here and elsewhere that they were not simply protesters. shepard? >> shepard: you know, wendell, france has been having internal problems among the folks regarding the muslims. now a french weekly has released car tunes that cartoons that depict mohammed in less than favorable light. >> the french are worried enough that they are closing diplomatic facilities in 2 o0

countries on fridays as a precaution. al qaeda group says this anti-islam film is proof that america's war on terror was really a war on islam. and it has called for more attacks against the u.s. diplomats, that's worried officials here who feel extremists are having some success exploiting rage over the video. condemning here both the violence and the video. >> whereas this may be repugnant it may be insulting, we may all be offended by it and we separate ourselves definitively from t as a government we are not involved. we believe in free speech. we believe that free speech should be protected and there is never an excuse for violence as a result of an insult. >> meanwhile, one of the actresses in the film has sued the producer for fraud. some of the dialogue in the film was clearly overdubbed. the actors say it was done without their knowledge. shepard? >> shepard: wendell goler live at the department of state tonight. lots of investigations internally.

tonight, there is no word on what may have really been behind last week's attack on the u.s. embassy in cairo. fox news has obtained an internal memo or i should say an intelligence memo which suggests the violent riots could be tied to a terrorist who is locked up right now here in the united states. the reporting is of catherine herridge and she will have that coming up inside fox report. but, first, the war in afghanistan. a senior official or officer in the u.s.-led military alliance in afghanistan says the response to these insider attacks against our troops there will not result in a major shift in the exit strategy. so-called green on blue attacks have killed at least 51 coalition troops this year. today, the pentagon announced temporary move as they call it to stop most u.s. and nato troops from working side by side with their afghan forces. today an australian brigadier general deputy chief of staff for the coalition in afghanistan criticism that this could change the overall

now a source has told us that that group may be tied to an islamic terror organization. no comment from bank of america on any possible connection. but a spokesman did say the following: our customer and client information online banking platform and the related systems remain safe and secure. the food and drug administration may soon consider whether to regulate how much of the toxic chemical arsenic can safely be present in the rice we eat. arsenic occurs naturally in the environment but it can cause cancer and is deadly at high doses. it can also accumulate in rice at higher levels than other foods because rice grows in standing water. right now, there are no guidelines as to how much arsenic can llweleynly be present in rice and there is no evidence to suggest that rice or rice products run safe to eat. all that said, "consumer reports" magazine has already called for limits in response, a spokesman for general mills, which makes the rice cereal, the magazine named says the company is confident its

products are safe. the kroger grocery company reports it's recalling spinach it sold in 15 states because of a possible list tiara contamination. kroger foods sold the spinach under the fresh selection tender spinach label in 10-ounce bags with a best if used by date of september 16th. kroger reports customers should return the recalled spinach to stores for a full refund or replacement, listeria can cause severe illness in pregnant women or folks with weakened immune systems. there is word the attack on the american embassy in cairo may have been an attempt to free a convicted terrorist right here in the united states. tonight, what the feds are saying about the chances of releasing a guy with ties to the world trade center attack. highest civilian honor of freedom to a fighter who spent 15 years under house arrest and apparently some of her local lawmakers back in her home country are learning democracy and watching it --

say she was playing outside with her 4-year-old cousin when this guy tried to grab the little boy. >> the -- [inaudible] >> he did. and police say thanks to the girl, he is now in custody. cops gave the girl a plaque and a standing ovation. >> shepard: i'm shepard smith, this is the fox report. it's the bottom of the hour. time for the top of the news. the justice department's internal watchdog has released a report that blasts more than a dozen people for their roles in the fast and furious gun sting. the nearly 500 page report criticizes 14 different justice department staffers for poor strategies, judgments, mistakes, and management failures. of course fast and furious was meant to follow guns to mexican drug cartels, the feds did not track some of those weapons and ban kits left two of them at the scene of a

shootout during which the border patrol agent brian terry died in 2010. already we are seeing fallout from today's report. one top official named in it has resigned and another retired. it is important to note though the report does not criticize the attorney general eric holder. and the report finds no evidence that he, eric holder, knew about the operation before early last year. the attorney general responded in a statement that reads, in part: i hope today's report acts as a reminder of the dangers of adopting as fact unsubstantiated conclusions before an investigation of the circumstances is completed. that, a clear shot at congressional republicans who have been hammering the attorney general holder for months over his connection to fast and furious. it's the top story at the bottom of the hour and mike immanuel has t from washington tonight. the justice department's inspector general is scheduled to testify on this matter, right? i think tomorrow. >> that's right, shep. he will be here on capitol hill. his name is michael e.

horowitz. he is the internal watchdog for the department of justice. he goal over his 471 page report. so you better believe top staffers and lawmakers here on capitol hill are doing some reading this evening to look into what went wrong with fast and furious. what needs to be done to prevent something like this from happening again. trying to figure out why the tactics were allowed to be done for a field office in tucson and making sure, again, that these type of tactics are never used again, shep. >> shepard: mike, what does this mean for the house lawmakers who have really been going after the attorney general on this matter? >> it sounds like they still feel like they were vindicated that there was reason to investigate this situation. they point to the two departures instantly after the report was released. jason weinstein, the deputy assistant attorney general is resigning from the department of justice. because this report says that he was the top official at justice, that could have stopped fashion and furious from happening.

then you have got the former head of the atf ken mel son who was retired. the report says atf senior leadership, including him, should have known about the tactics and risk to public safety and repeatedly failed to act in a timely fashion on this info. bottom line, house republicans say they still have lots of questions. >> we have always said that we wanted people to be held accountable. so 14, you know were recommended, two were dealt with and taken care of today. but the attorney general has to hold those people accountable and there is probably more people that potentially will be implicated along the line. >> jason chafe fets tells me is he comply complimentary of the report and is going through it tonight. >> bill: mike emanuel is on capitol hill. we are learning now what may have sparked last week's violent attack on the u.s. embassy in egypt. fox news has now obtained an intelligence report which suggests the assault may have

quote: the time has come from a strong movement you o sons of egypt to release your known sheikh. detained sheikh is released. this by the reuters news service in cairo shows demonstrators wearing the same head covering as the blind sheikh and posters of the sheikh were in full view during the protest at thest embassy. congressional sources tell fox they believe the demonstrations in cir royy in response to that amateurish movie and undercurrent release of a sheikh held in prison in north carolina. >> shepard: that video really pulls it together. what's the administration saying about the blind sheikh? >> together 8 senior republicans sending a letter to the justice department and the state department. lawmakers responding to published reports that the blind sheikh omar rockman convicted in that first world trade center attack could be transferred to egyptian authorities for humanitarian and health reasons. a justice department source telling fox the idea of transferring the sheikh

apparently trying to learn democracy by watching old episodes of an american tv show. that's the word from the secretary of state hillary clinton. she spoke today at a ceremony to honor the burmese activist with the congressional gold medal, the highest civilian honor that congress can award. and secretary clinton recalled a conversation with a house speaker in burma in which he asked her to help lawmakers learn how to create a democratic process. >> he went on to tell me that they were trying to teach themselves by watching old segments of the west wing.
